ACCEPTANCE OF GENERAL TERMS AND CONDITIONS

The general terms and conditions of sale detailed below (hereinafter referred to as the "General Terms") govern the contractual relationship between any user of the MCZDIRECT™ website (hereinafter referred to as a "Customer") and the MCZDIRECT™ commercial brand.

These general terms and conditions of sale are the only applicable terms and replace all other terms, unless a prior, express, and written derogation is granted. MCZDIRECT™ may occasionally modify certain provisions of its general terms and conditions, so it is necessary to review them before each visit or order on the MCZDIRECT™ website (hereinafter referred to as the "Site"). These modifications are enforceable as of their publication online and do not apply to contracts concluded prior to the changes. Each purchase on the Site is governed by the General Terms applicable on the date of the order. We consider that by validating your order, you accept our general terms and conditions of sale without reservation after having read them. By accessing the Site, you agree to comply with the General Terms as well as the Terms of Use listed therein.

EFFECTIVE DATE

These general terms and conditions come into effect on the date of signing the purchase order. These general terms and conditions are concluded for the duration necessary to provide the goods and services subscribed to, until the expiration of the warranties owed by MCZDIRECT™.

GENERAL INFORMATION

We are a dynamic team based in Hong Kong and Singapore. We sell either products we have in stock or products available immediately from our various suppliers. All our products are carefully selected and inspected to ensure your complete satisfaction.

VAT AND IMPORT TAXES – SIMPLICITY AND PEACE OF MIND GUARANTEED

With our "VAT Exemption" commitment, you benefit from total peace of mind: no additional fees related to imports will be charged to you (import taxes, shipping fees, VAT, or GST). All our prices are tax-free, with no hidden surprises.

If, however, import fees or VAT are requested by the carrier upon receipt of your package, simply advance the payment and send us the official receipt. We will take care of the rest and reimburse you immediately.

Refund Guarantee
We understand the importance of transparency. For us to refund you, simply send us the VAT receipt by email. Upon receipt, we will process the refund without delay.

Refund Request Deadline
You have 60 days from the shipment of your order to send us the VAT receipt. After this period, we will unfortunately no longer be able to cover these fees.

Billing and VAT
Our company is not subject to VAT, so we are unable to provide an invoice with taxes included.

PRICES

The sale prices indicated on the site are in euros (€) with free shipping. Shipping fees are free for the entire site. The total amount is indicated to the customer at the end of the order process before confirming acceptance. We reserve the right to modify our prices at any time, but we commit to applying the prices indicated on the site at the time of your order. No discount will be granted if the price of the product decreases in the meantime. If an item is sold with a manifest pricing error that the customer could not have ignored in good faith (Article 1109 of the Civil Code), we reserve the right, in accordance with applicable legislation, to cancel the order and refund the customer. We will inform you as soon as possible. You will then be able, if you wish, to reorder at the corrected and accurate price.

PAYMENT

The user also has the option to pay the amount of their order by bank transfer to our European bank account with IBAN. Bank transfer fees are the responsibility of the customer. (Free in most cases, depending on the bank).

Payments by credit card on our site are secured through our partnership with Airwallex, which offers a fully integrated 3D Secure solution, enhancing the security of online transactions.

DESCRIPTION

We take the utmost care to accurately describe the information for each of our products; however, they are provided for informational purposes only, and we remain entirely at the customer's disposal for any clarification regarding the details of each product. Photos are non-contractual. As our products are direct imports from Asia, the package contents may not include a user manual in your language, but we systematically provide this manual in the language of the destination country of the order in PDF format. We will send you an email with the download link.

QUALITY CONTROL BEFORE SHIPMENT

Please note that all packages are opened before shipment for quality control by our order preparers. They check the menu language, the new condition of the item, and add the necessary power cable or adapter for the destination country of the order. This quality control, as well as the order preparation, is filmed for security purposes.

AVAILABILITY

Please note that we will honor your order within the limits of our available stock. Our offers are valid subject to availability from our suppliers. In the event of unavailability of your order, if one of the products ordered is not available in our stock, we commit to contacting you by email within 15 days from the date of your order to inform you and indicate the timeframe in which this product could, if applicable, be delivered to you. It is also possible to cancel the order and refund you within 3 to 4 business days following the date of cancellation of your order.

DELIVERY

Shipping fees are free for delivery within the European Union. Products are delivered to the address indicated by the user on the purchase order. We will regularly keep the customer informed of the progress of the payment and delivery. The average delivery time is 6 to 12 business days. All our orders are sent with a signature required. Once the order is handed over to the carrier, a tracking number will be provided to you.

ABSENCE ON THE DAY OF DELIVERY

Depending on the case, the carrier may leave a notice in the customer's mailbox, inviting them to contact the carrier or the nearest depot. This situation is usually indicated on the website of the delivery organization. It may happen that the notice is not found by the customer, and it is then their responsibility to track their package online to be informed of the situation as soon as possible.

STRIKE OR FORCE MAJEURE EVENT

MCZDIRECT™ makes every effort to fulfill all its commitments, including the delivery time mentioned on the site. However, we cannot be held responsible in the event of a strike by carrier services or any other exceptional event slowing down or preventing the delivery of packages. In the event of non-receipt of a package within the indicated timeframes, an investigation is conducted with the carrier and may take several days. During this period, no refund or reshipment can be made. At the end of this investigation, and if it indicates a service failure by the carrier, the customer will be fully refunded or the product will be reshipped, according to the customer's preference. Upon receipt of your package, please verify the conformity of the delivered products with your order and notify us, if applicable, on the delivery note and in the form of handwritten reservations accompanied by your signature, of any anomalies concerning them.

IN CASE OF LOSS/THEFT DURING DELIVERY

If the package is lost by the carrier or if the goods inside the package have been stolen during transit, contact us immediately. We will then provide you with the serial number of the item so that you can file a complaint against the carrier at the nearest police station. Please send us a copy of the report you will receive, along with a copy of an ID and other documents. Please contact our logistics department to inform us of the problem encountered so that we can be as responsive as possible. We will only be able to fully refund you upon receipt of these elements. Unfortunately, we will not send a new package in the case of theft during delivery, as we prefer to wait for the end of the investigation conducted by the carrier, which may take several months.

RESERVATION OF OWNERSHIP

MCZDIRECT™ remains the owner of the delivered goods until full payment by the customer. The preceding provisions do not prevent, upon delivery of the goods, the transfer to the customer of the risks of loss or damage to the goods subject to reservation of ownership, as well as any damage they may cause.

WARRANTY AND RETURN

a) We wish to inform our customers that all products offered on our platform, MCZDIRECT, are imported. Due to the absence of an international warranty provided by manufacturers, the manufacturer's warranty may not be applicable in some cases.

MCZDIRECT Commitment

To address this limitation, MCZDIRECT offers a specific seller warranty for all products sold within the European space, in compliance with European regulations. The duration of this warranty varies depending on the country of purchase:

  • Portugal and Spain: 3 years

  • France, Belgium, and other EU countries: 2 years (3 years for orders after June 1, 2024)

This warranty covers manufacturing defects from the date of invoicing. In case of a defect or malfunction, customers must contact our service and return the product for repair. Repairs, including labor and spare parts, will be carried out by our partner SAV before returning the product in working condition.

Return Procedure for SAV

It is crucial to contact MCZDIRECT before any return to the SAV center to avoid additional fees. To initiate a warranty return, contact us at contact@mczdirect.com to receive all necessary instructions. Shipping fees to our SAV partner are the responsibility of the customer, while the return of the repaired product is covered by MCZDIRECT.

Warranty Exclusions

The warranty does not cover damages due to:

  • Non-compliant use of the product.

  • Damages resulting from impacts, shocks, falls, presence of sand, dust, dirt, humidity, battery leaks, fires, theft, attempted theft, vandalism, war, terrorism, corrosion, contamination, water infiltration, freezing, floods, winds, earthquakes, storms, or any other extreme weather conditions.

  • Accidental or intentional damages.

  • Damages due to exposure to humidity or extreme temperature conditions.

  • Misuse, improper storage, or incorrect handling of the product.

  • Damages related to cleaning the product (dust, sensor, lenses, etc.).

  • Damages caused by using the product with a power source of incorrect voltage.

  • Violation of the terms of this warranty or the contract.

  • Non-compliance with the written instructions provided with the product or those of the manufacturer.

  • Damages or defects resulting from negligence by anyone other than us.

  • Loss of quality, performance degradation, or damages resulting from the use of spare parts or other components (such as consumables) not produced or recommended by the manufacturer.

  • Damages or defects resulting from modifications to the product and/or its software made by anyone other than our authorized representatives.

  • Alteration, illegibility, or modification of the product's serial number.

  • Damages or defects resulting from connecting the product to equipment, accessories, software, or networks not approved by the manufacturer.

  • Damages due to external causes beyond our control, including but not limited to accidents, fires, or burglaries.

  • Repairs or cleaning of the product performed with inappropriate tools or incorrect procedures.

  • Defects resulting from attempting to open the product casing for self-repair.

  • Loss or damage of data.

  • Damages or defects resulting from connecting the product to a network not approved by the manufacturer or unauthorized modifications to your operating system or network.

  • Damages to the display screen (LCD) due to misuse.

  • Damages occurring due to inappropriate packaging during shipment to the service center or service agent.

  • Damages resulting from the use of waterproof cameras or waterproof housings at depths exceeding those recommended.

  • Dead pixels not reported within 14 days of receiving the item.

Note on Third-Party Lenses

MCZDIRECT covers repairs due to manufacturing defects, excluding issues related to third-party lenses. The use of such lenses is at the user's discretion, with no guarantee from us regarding the quality or reliability of the focus. In case of a problem, MFA tools must be used, and the camera and lens must be returned to the manufacturer for inspection.

Protecting Your Product

We recommend removing any memory card or non-essential accessory before returning the product to us, as MCZDIRECT cannot be held responsible for data or accessory loss.

This communication aims to ensure total transparency regarding the warranty coverage offered by MCZDIRECT, to maintain the trust and satisfaction of our customers.

b) You have up to 14 clear days to return the order in its original condition. You must return it to our return address in Hong Kong. Please make the request by email. Please note that for this, the product must not have been used or show signs of use, whether physically or internally. Products must be returned in their original condition: new, with all accessories and protective films allowing for resale as new. Upon receipt and after verification of your return, you will be refunded. If this is not the case, the return will be refused. Shipping fees will then be charged to you.

Regarding accessories such as batteries, filters, memory cards, etc.: if the packaging has been opened, we will not proceed with a refund or exchange.

If you notice a malfunction or failure within 14 days of delivery, you can return the product to us free of charge under the same conditions as paragraph "b)". The product must be returned in the same condition as received. The product, accessories, and packaging must be intact.

Otherwise, we will not proceed with an exchange/refund but with an SAV treatment. If the origin of the malfunction is found to be due to mishandling, shock, or contact with water, we will provide you with a quote to repair the product or return it to you as is, plus a fee of €59 to cover diagnostic and shipping costs.

If, in the case of a return within 14 days, the product shows signs of inappropriate use, shock, or damage, or if accessories delivered with the device are missing, we will not proceed with an exchange, we will handle the issue through our SAV, and it will be returned to you under the same conditions as paragraph "a)".

If you wish to cancel the sale while the package is already in transit but not yet delivered, the cancellation and return shipping fees will be deducted from your purchase refund.

PERSONAL DATA PROTECTION

The information you provide us is essential for processing and shipping orders, issuing invoices, and warranty contracts; its absence results in the cancellation of your order. By registering on our MCZDIRECT™ site, you agree to provide us with sincere and accurate information about yourself. Providing false information is contrary to these general terms and conditions as well as the terms of use on the Site. You thus authorize MCZDIRECT™ to collect, process, and use the information concerning you.

You of course have a permanent right of access and rectification to all data concerning you, in accordance with European texts and national laws in force (Article 34 of the Law of January 6, 1978). You can at any time make a request to MCZDIRECT™ to find out what information we have about you, and you can modify this data as you see fit. If you have agreed to it during your identification on the Site, promotional emails offering you new products, clearance sales, exclusives, good deals, or simply to inform you of news, will be sent to you. You can request to no longer receive these emails at any time by clicking on the link provided for this purpose and inserted at the bottom of each email sent to you, or by going to our customer area in the "Personal Information" section.
